Terms and Conditions

THIS AGREEMENT, entered into and made effective from January 1, 2009, by and between SJP/Caritas of Birmingham, herein referred to as “Site Owner,” and the individual(s) who access the site(s) owned by the Site Owner, via computer(s) or other instrument(s) or device(s), herein referred to as “the User,” and the mejList electronic or otherwise mail list(s), herein referred to as “the List” as follows:

The User’s membership of the List, agrees them to the following terms:

The User understands and agrees that the List is the sole property of the Site Owner, and the User makes no claim of ownership whatsoever. This includes any corresponence between the Site Owner and the User.

The User understands and agrees that their membership(s) grants them no usage of the List, nor any claim of right of usage of the list.

Further, the User understands and agrees that the information contained in the List is CONFIDENTIAL and PROPRIETARY, that the said information cannot be easily obtained through a publicly published means; that any breach of security or obtainment though any other means is considered CRIMINAL and shall be prosecuted to the fullest extent of the law.

The User understands and agrees that their computer(s), device(s), or other instrument(s) used to access the site(s) are subject to search and seizure, and/or subpoena by the Site Owner for the purposes of investigation, should there be a breach of security of the List, or obtainment of the List by the User.

The above terms hold true and valid in the event of direct criminal activity by the User, the User receiving the information via a 2nd, 3rd party and so forth, or accidental obtainment of the List by the User.

Any attempt by the User to pass the information contained in the List to any other party, copy, print, or otherwise disseminate shall be considered CRIMINAL, and shall be prosecuted to the fullest extent of the law.

Any attempt by the User, contrivance, conspiracy, or otherwise plan(s) to use the List for criminal activity, blackmail, extortion, or otherwise any other means of dissemination or attempt of dissemination shall be prosecuted to the fullest extent of the law.

The User understands and agrees that they shall not have possession of any information of the List, including any correspondence between the Site Owner and the User, and that the Site Owner may use any correspondence with the User in publication(s) at the Site Owner’s discretion. This includes correspondence pertaining to unsubscriptions from the list.

The User understands and agrees that the Site Owner considers and holds the List under the highest security, that the Site Owner does not share nor divulge any of their personal information, nor does the Site Owner consider the List to be available for rent, lease, sale, or otherwise able to leave the possession of the Site Owner.

The User agrees to be responsible for and to indemnify and hold harmless Caritas, Medjugorje.com, Community of Caritas, and connected organizations (and its officers, directors, employees, agents, representatives, successors, and assigns) from and against any liability, claim, loss, damage or expense, including reasonable attorneys’ fees and legal costs, incurred by User (and/or its officers, directors, employees, agents, representatives, successors and assigns) by reason of any claim, demand, or action asserted by User or any third party relating to any liability.

This Terms and Conditions shall be governed under the laws of the State of Alabama. No part of this Terms and Conditions not applicable by law shall invalidate those parts that are applicable by law.
